1. What is an employment contract?
An employment contract is an agreement between an employer and an employee in which the employee commits to providing certain services on behalf of the employer and under their direction, in exchange for compensation.
2.About the trial period
- It is optional to establish, and if agreed upon, it should be documented in writing within the contract.
- Its maximum duration is set in Collective Agreements, and in the absence of such agreements, the duration cannot exceed six months for qualified professionals or two months for other workers.
- During the probationary period, the employee will have the same rights and obligations corresponding to the position they hold as if they were a permanent employee.
- During this period, the employment relationship can be terminated at the will of either party, without alleging any cause and without prior notice, unless otherwise agreed.
- The probationary period is counted for seniority purposes.
- The situation of temporary incapacity that affects the worker during the probationary period will interrupt its calculation, provided that there is an agreement between both parties.
- In companies with fewer than 25 employees, the probationary period cannot exceed three months for non-qualified professionals.
- A probationary period cannot be established when the worker has already performed the same functions in the company previously, under any type of contract.
3. Permanent employment contract mode
A permanent employment contract is one that is entered into without establishing time limits on the provision of services, regarding the contract’s duration. The indefinite employment contract may be verbal or written and can be entered into for full-time, part-time, or fixed-discontinuous service provision.
In some cases, indefinite contracts may be eligible for hiring incentives, provided that the requirements set forth by the applicable regulations are met. This depends on the characteristics of the company, the worker, and, where applicable, the work schedule.
