When we hire a domestic service worker, whether through L’Atelier10, a domestic service agency in Madrid, or on your own, we must register this person to formalize the employment relationship between both parties, regardless of the number of hours and days they will work in our home, the domestic tasks to be performed, and the type of contract.
This is a responsibility and obligation that falls on the employer for the purpose of communicating with Social Security, and failure to do so may result in penalties.

We want to emphasize that registering a person in the Special Household Employment System is a relatively simple task that can be carried out through the new portal of the General Treasury of Social Security. You can access it from any mobile device or computer with an internet connection, thus avoiding the inconvenience and time loss associated with handling the same procedures or paperwork in person at an office of the General Treasury of Social Security (TGSS).”

Upon entering the portal, the employer must identify themselves using one of these 3 methods to access their personal area:

1. Employee Information: Type and identification number (DNI or NIE) and date of birth.
2. Employer Information: At this point, it is important to inform whether the worker will be caring for a large family, as this may lead to a bonus.
3. Contract Duration: It is necessary to indicate the start date of the activity and the type of contract (indefinite or fixed-term).
4. Work Schedule and Salary: Specify if the contract is full-time or hourly, the number of weekly or monthly working hours, the agreed-upon salary, whether holiday pay is included, and if there are other amounts such as in-kind remuneration, etc. After providing all this information, the system then displays the monthly fee to be paid by the employer.
5. Address where the work will be performed.
6. Insurance Provider: Select one of the insurance provider options, either the INSS or a collaborating Mutual.
7. Contact Information: Employer’s contact information.
8. Bank Direct Debit: The account where the corresponding monthly fee will be charged.

After confirming that the data is correct, the employer must give their consent and can sign the registration request and download the corresponding receipt.

In addition to the registration, data changes in the type of contract due to new conditions or processing of terminations can be made within the 3 natural days following the end of the employment relationship.

If the interested party does not have any of the 3 identification methods mentioned above, they also have the option to use the request submission service on the portal without the need for prior identification. In this case, upon entering the website, you can even use a virtual assistant that helps with all the steps to follow.

In this case, to submit the request and process the registration, the following must be completed:

  • Employer’s Information: personal information, home address, Contribution Account Code (CCC), bank details for direct debit of contributions, and attach a copy of the identity document.
  • Domestic worker’s Information: personal information, attach a copy of the ID or NIE, and Social Security number (NUSS), which means all the essential legal documentation for foreign individuals to have authorization to reside and work in Spain.
  • Employment relationship details (number of hours worked, monthly remuneration, start date, if there are any in-kind benefits, etc.).
  • The employment contract (you have the option to download the template), which must always be formalized in writing between both parties.
  • Access to the form with the Social Security registration form.

When completing the domestic worker registration process, it is crucial to remember that this must always be processed before the start of the employment activity, with a maximum lead time of 60 days, and it is the responsibility of the employer, just like the payment of contributions.
