1. OBJECT AND SCOPE OF APPLICATION. These General Terms of Use (hereinafter referred to as the “Terms of Use”) aim to regulate access to the content and services of the website owned by l’Atelier 10, located at Avenida Pio XII 94, available at the URL www.L’atelier10.com. 1.1. By accessing, browsing, or using the website’s services and content, the User acknowledges having read, understood, and unconditionally accepted the Terms of Use. In this regard, a User is considered to be any person who uses, browses, or accesses any of the content and services offered on the website. The User agrees to use the website in accordance with the law and the provisions of these Terms of Use and the Privacy Policy published on the website. The User must refrain from engaging in any unlawful acts or acts contrary to these Terms of Use. 1.2. However, access to certain content and the use and/or acquisition/provision of certain services may be subject to specific Terms and Conditions of Contract, which, as applicable, will replace, supplement, and/or modify these Terms of Use. In case of contradiction, the contradictory terms of the specific Terms and Conditions of Contract will prevail over the provisions of these Terms of Use. 1.3. L’Atelier 10 reserves the right to modify the presentation, configuration, content of the website, and any of its services, as well as the conditions required for access, use, and/or provision of the offered services. Accessing and using the content and services after the modifications come into effect or changes in the conditions imply acceptance of the same.
2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS. 2.1. This website is governed by national and international legislation on intellectual and industrial property. 2.2. Under no circumstances shall accessing and browsing the website or using, acquiring, and/or contracting products or services offered through it imply a waiver, transmission, license, or total or partial assignment of said rights by l’Atelier 10. 2.3. It is not permitted to delete, bypass, or manipulate the copyright notice and any other identification data of l’Atelier 10’s rights. Likewise, it is prohibited to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or subsequent publications, upload files, send by mail, transmit, use, process, or distribute in any way all or part of the contents and products included in www.latelier10.com for public or commercial purposes without prior express written authorization.
3. USE OF THE WEBSITE. 3.1. The User will have access to the content and use of the services provided by the website free of charge, although some services may be subject to prior registration, prior contracting, and/or payment by the User, as specified in their respective General Terms and Conditions of Contract. By using the services and/or accessing the content of the website, the User expresses their agreement with these Terms of Use, undertaking not to use them to send defamatory or insulting messages or messages containing false information, inappropriate, abusive, harmful, pornographic, threatening, damaging the public image or private life of third parties or violating any laws. 3.3. In particular, and merely by way of example and not exhaustively, the User undertakes not to collect data for advertising purposes, not to send any type of online advertising, and not to transmit, disseminate, or make available to third parties through the services that may be provided by l’Atelier 10, any information, messages, graphics, sound or image files, photographs, recordings, software, and in general any kind of material, data, or content that, without limitation: • Engages in illegal activities,• In any way contravene, belittle, or undermine constitutionally recognized fundamental rights and public freedoms or those recognized in international treaties and the rest of the legal system; • Induce, incite, or promote criminal, denigrating, defamatory, or violent actions; • Induce, incite, or promote discriminatory actions, attitudes, or ideas based on sex, race, religion, beliefs, or age; • Incorporate criminal, violent, or degrading messages; • Induce or incite involvement in dangerous, risky, or harmful practices for health and mental balance; • Be false, ambiguous, inaccurate, exaggerated, or untimely in a way that may mislead regarding its object or the intentions or purposes of the communicator; • Be protected by intellectual or industrial property rights belonging to third parties, without the User having previously obtained the necessary authorization from their owners to carry out the use they are making or intending to make; • Violate third-party trade secrets; • Be contrary to the right to honor, personal and family privacy, or the image of individuals; • Infringe regulations on communication secrecy; • Cause difficulties in the normal functioning of the Services due to their characteristics (such as format, extension, etc.).
4. LICENSE ON COMMUNICATIONS. 4.1. In the event that the User sends any type of information to Látelier10 through the Website, using the channels provided for this purpose on the Website itself, the User declares, guarantees, and accepts that they have the right to do so freely, that such information does not infringe any intellectual property rights, trademark rights, patent rights, trade secrets, or any other rights of third parties, that such information is not confidential, and that such information is not harmful to third parties. 4.2. The User acknowledges and assumes responsibility and shall indemnify Látelier10 for any communication provided personally or on their behalf, with such responsibility encompassing without any restriction the accuracy, legality, originality, and ownership of said communication.
5. RESPONSIBILITIES AND WARRANTIES. 5.1. L’atelier 10 cannot guarantee the reliability, usefulness, or truthfulness of the services or information provided through the Website. Consequently, L’atelier 10 does not guarantee nor take responsibility for: (i) the continuity of the contents of the Website; (ii) the absence of errors in such contents or products; (iii) the absence of viruses and/or other harmful components on the Website or on the server that supplies it; (iv) the invulnerability of the Website and/or the impenetrability of the security measures adopted therein; (v) the lack of usefulness or performance of the contents and products of the Website; (vi) the damages or harm caused, to oneself or to a third party, by anyone who violates the conditions, rules, and instructions established by L’atelier 10 on the Website or through the breach of its security systems. 5.2. However, L’atelier 10 declares that it has taken all necessary measures, within its means and the state of technology, to ensure the functioning of the Website and to prevent the existence and transmission of viruses and other harmful components to Users. If the User becomes aware of the existence of any illicit, illegal, contrary to the law, or potentially infringing content on intellectual and/or industrial property rights, they must immediately notify L’atelier 10 so that appropriate measures can be taken.
6. LINKS. 6.1 Links to other websites In the event that the User could find links to other websites through buttons, links, banners, etc. on the Website, these links would be managed by third parties. L’atelier 10 does not have the authority or the human and technical means to know, control, or approve all the information, content, products, or services provided by other websites to which links may be established from the Website. Consequently, L’atelier 10 cannot assume any responsibility for any aspect related to the linked website, specifically including, but not limited to, its operation, accessibility, data, information, files, quality, and reliability of its products and services, its own links, and/or any of its content in general. In this regard, if Users become aware of any illegal activities carried out through these third-party websites, they must immediately notify L’atelier 10 so that appropriate action can be taken to disable the access link. The establishment of any type of link from the Website to another external website does not imply the existence of any relationship, collaboration, or dependence between L’atelier 10 and the responsible party of the external website. 6.2 Links on other websites pointing to the Website If any User, entity, website, or web page wishes to establish any type of link pointing to the Website, they must comply with the following stipulations:
The link may only be directed to the Homepage or Home of the Website, unless expressly and in writing authorized by L’atelier 10.
The link must be absolute and complete, meaning it must take the User, through a click, to the exact URL address of the Website and must occupy the entire screen extension of the Homepage of the Website. 7. DURATION AND MODIFICATION. 7.1 L’atelier 10 may modify the terms and conditions stated here, in whole or in part, by publishing any changes in the same manner as these Terms of Use, through any type of communication directed to the Users. 7.2 The temporary validity of these Terms of Use coincides, therefore, with the time of their exposure, until they are modified in whole or in part, at which point the modified Terms of Use will become effective. 7.3 Regardless of what may be provided in any Specific Conditions established, L’atelier 10 may terminate, suspend, or interrupt access to the website’s content at any time without prior notice, without the User being entitled to any compensation. After such termination, the prohibitions on the use of the content stated above in these Terms of Use will continue to be in effect.
8. GENERAL PROVISIONS. 8.1 The headings of the various clauses are for informational purposes only and shall not affect, qualify, or expand the interpretation of the Terms of Use. 8.2 If any provision or provisions of these Terms of Use is deemed null or unenforceable, in whole or in part, by any competent Court, Tribunal, or administrative body, such nullity or unenforceability shall not affect the other provisions of the Terms of Use. 8.3 The failure or omission by L’atelier 10 to exercise or enforce any right or provision contained in this Legal Notice shall not constitute a waiver thereof, unless expressly acknowledged and agreed to in writing by L’atelier 10.
9. CONSUMER GOODS WARRANTY. In the event of a defective product, the seller must proceed with its replacement or contract resolution, which shall be free of charge for the consumer. The consumer must inform the seller of the lack of conformity within fifteen days from the date they became aware of it. Prior to that, once L’atelier 10 is informed about the defective product, it will undergo a quality control process to determine whether the defect is due to the use of the item or a manufacturing defect.
10. JURISDICTION. These General Conditions are governed by Spanish law. The parties, by their choice, submit to the courts and tribunals of the user’s domicile for the resolution of any conflicts, waiving any other jurisdiction.
